This artificial intelligence (“AI”) notice (“AI Notice”) is applicable to Framer B.V., a Dutch limited liability company, and its affiliates (“Framer”), and the entity or person placing an order for or accessing Framer’s Service (“Customer” or “You”).  

  1. Purpose and scope 

1.1 Framer uses AI to enhance the functionality, efficiency and user experience of our platform and related services (“Framer AI Features”). A comprehensive list of AI features can be found at www.framer.com/ai.

1.2 This AI Notice is incorporated into and forms part of the agreement governing the Customer’s use of the Services, being either the Framer Terms of Service or the signed master subscription agreement between the parties, together with any applicable order forms (the “Agreement”). Capitalized terms not defined in this AI Notice shall have the meanings ascribed to them in the Agreement.

1.3 At Framer, we are committed to the responsible, transparent and lawful use of AI in accordance with Regulation (EU) 2024/1689 (“AI Act”) and other applicable regulations. This AI Notice provides an overview of how AI is used in a responsible manner with regards to our Service and provides information about the safeguards we apply. 

1.4 The parties acknowledge that: (a) Framer utilizes third-party providers of AI models (“Third-Party Models”), as described in section 5 (AI Models) below; (b) utilizes standard AI systems offered by those providers that have not been customized or developed specifically for Framer; and (c) Framer AI Features are not intended for use cases that would qualify them as a “high-risk AI system” as defined under the AI Act or applicable law.

  1. Our commitment under the AI Act 

2.1 Framer is committed to supporting the principles and objectives under the AI Act to promote the safe, responsible and fair use of AI. This means, among other things, that Framer fosters:  

  • Transparency: we provide clear information about when and how AI is used and You are informed that the content was generated or suggested by AI. 

  • Safety: AI features and functionalities used by Framer are tested and monitored according to industry standards.

  • Data minimization and privacy: we ensure all data processing with respect to the use of AI is lawful. For more information on the processing of personal data, we refer to our Privacy Statement found at www.framer.com/legal/privacy-statement.

  1. Human Oversight and AI literacy 

3.1 AI-generated output may not always be accurate. Framer emphasizes the importance of maintaining human oversight in the use of AI systems. In line with the AI literacy requirements set out in the AI Act, Framer considers it essential that any recommendations or assessments made by AI are reviewed, and that final decisions are made by appropriately qualified Customer employees. 

3.2. In terms of AI literacy, Framer provides a sufficient level of AI literacy among employees and other persons using AI systems on Framer’s behalf. This means that employees have the right skills, knowledge and understanding to deploy AI systems responsibly.   

  1. Use and Limitations 

4.1 Content produced by AI is automatically generated and may contain inaccuracies or incomplete information. This content is not reviewed or endorsed by Framer. Framer makes no representations or warranties regarding the reliability or correctness of any AI-generated materials and assumes no responsibility for how You use them. It is your responsibility to carefully assess and verify all AI-generated content for accuracy, appropriateness, and legal compliance, including conducting your own review and obtaining any required approvals or rights. By using the Framer AI Features, Customer acknowledges and agrees that Framer is not responsible for any (a) inaccuracies, hallucinations, disinformation, poisoned data, or other errors in the Output (as defined in section 4.2), (b) biases or limitations of the underlying algorithms or data, (c) Output that Customer may find harmful or offensive, (d) Outputs that potentially violate nondisclosure agreements and/or other contractual and confidentiality obligations, and (e) Outputs that fail to disclose the content's non-human origin. If Customer encounters any Output that is harmful, offensive, or not appropriate, please promptly report it to trustandsafety@framer.com.

4.2 Customer may provide input to be processed by Framer AI Features (“Input”), and receive output generated and returned by the Framer AI Features based on the Input (“Output”). As between the parties, Input, which does not include publicly posted content from other users or third parties on the Framer Marketplace, and Output are Content, as applicable. Customer acknowledges that Output may not be unique and the Framer AI Features may generate the same or similar Output for any number of users. Customer will not provide Input or attempt to generate Output through Framer AI Features that contains any personal data, sensitive personal data, or special category personal data. Customer is solely responsible for the development, content, operation, maintenance, and use of Content, as applicable. 

4.3 In addition to the matters listed in our Acceptable Use Policy, Customer will not provide Input, or use or facilitate, or allow others to use or facilitate, the Output and the Framer AI Features (i) to develop data sets, foundation models, or other large scale models that may compete with Framer or Framer AI Features; (ii) to mislead any person or imply that Output generated using the Framer AI Features is unique or solely human generated; (iii) in a manner which violates each respective Third-Party Model terms or codes of conduct, or any content and use policies Framer may implement from time to time; (iv) to generate spam or content for dissemination in an unlawful manner; (v) for use cases prohibited by the AI Act or other applicable law, or that would result in Framer AI Features being considered a “high-risk AI system” under such laws; (vi) in a way that violates any applicable laws, the terms outlined in the Agreement, this AI Notice or other Framer policies, or (vii) in a manner that infringes, violates, or misappropriates any of Framer’s rights or the rights of any third party.

  1. AI Models 

5.1 Third-Party Model. Where we integrate Third-Party Models in our platform and systems, Framer evaluates their safety, fairness, and data practices. Such third-parties are listed on our subprocessor page found in Framer’s Trust Center.

5.2 Bring Your Own Model (BYOM). To the extent Customer integrates, deploys, or uses Customer-provided models in connection with the Service, Customer assumes full responsibility for such models, including their training data, performance, Inputs, Outputs, and compliance with applicable laws. Framer disclaims all liability arising from or related to such models, and Customer shall defend, indemnify, and hold harmless Framer and its affiliates, and their respective officers, directors, employees, and agents, from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (i) Customer Inputs; (ii) Customer’s use of the Service or Outputs in violation of the Agreement; (iii) any allegation that the Inputs or Customer’s use of the Outputs infringe, misappropriate, or otherwise violate any third-party rights; or (iv) Customer’s failure to comply with applicable laws or regulations in its use of the Service.

  1. Intellectual Property

6.1 As between the parties, Framer owns all right, title, and interest in and to the Framer AI Features and any resulting usage data, including all intellectual property and proprietary rights therein. Framer AI Features shall be deemed to be included in the applicable definition of “Intellectual Property Rights”.

  1. Training

7.1 For the avoidance of doubt and per contractual requirement, none of the providers of Third-Party Models have the right to use Customer’s Inputs and Outputs to train their AI models. All non-Enterprise Plan customers hereby grant Framer a worldwide, limited, irrevocable, non-exclusive right and license to use and reproduce Customer’s Inputs and Outputs in a deidentified manner for the purposes of training Framer artificial intelligence models. For Enterprise Plan customers, Customer’s Inputs and Outputs will not be used for training Framer’s artificial intelligence models.

  1. Disclaimer

8.1 CUSTOMER UNDERSTANDS AND AGREES THAT ANY CONTENT OR OUTPUT OBTAINED THROUGH THE USE OF THE FRAMER AI FEATURES IS PROVIDED “AS-IS” AND OBTAINED AT CUSTOMER’S SOLE RISK. CUSTOMER SHOULD NOT RELY ON FACTUAL ASSERTIONS IN OUTPUT WITHOUT INDEPENDENTLY FACT CHECKING THEIR ACCURACY AS OUTPUTS THAT APPEAR ACCURATE BECAUSE OF THEIR DETAIL OF SPECIFICITY MAY STILL CONTAIN MATERIAL INACCURACIES. FRAMER CANNOT DYNAMICALLY RETRIEVE INFORMATION, AND OUTPUT MAY NOT ACCOUNT FOR EVENTS OR CHANGES TO UNDERLYING FACTS OCCURRING AFTER THE AI MODEL WAS TRAINED. NO INFORMATION OR ADVICE, WHETHER WRITTEN OR ORAL, OBTAINED BY CUSTOMER FROM FRAMER OR THROUGH THE FRAMER AI FEATURES SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.

  1. Updates and Contact 

9.1 This AI Notice may be updated as regulations evolve and our use of AI changes. Please check this AI Notice available at Framer’s website (www.framer.com) regularly to ensure that You are aware of the most updated version.

  1. Service Levels Not Applicable

10.1 Notwithstanding anything to the contrary in the Agreement, downtime of the Framer AI Features that results from failure of a third-party service will not be included in the availability or uptime calculations.
